Every foreigner who lives in the territory of Indonesia, either temporarily or permanently, is required to have a residence permit. The regulation is contained in Law no. 6 of 2011 article 48 paragraph (1). Immigration stay permits that can be owned by foreigners consist of Visit Stay Permits (ITK), Limited Stay Permits (ITAS), and Permanent Stay Permits (Itap).

ITK is given to foreigners who live and are in the territory of Indonesia for a short period of time and for the purpose of a visit. ITAS is given to foreigners who enter the territory of Indonesia with a limited stay visa or foreigners who are granted status transfer from ITK. Finally, Itap is given to certain foreigners to reside and settle in the territory of Indonesia as Indonesian residents.

The following conditions must be met to obtain this permit.

1. Terms of Visit Stay Permit (ITK)

a). An application for a visit Stay Permit for foreigners who enter the territory of Indonesia with a visit visa, must attach:

  • Guarantee letter from guarantor at the time of applying for a visa
  • A valid and valid passport.

b). For children born in the territory of Indonesia to parents holding ITK, an ITK can also be made. Parents must fill out the application form and attach:

  • Child’s national passport from the representative of his country in Indonesia
  • Child birth certificate from the hospital or birth certificate from the authorized official
  • Photocopy of parent’s national passport – Photocopy of parent’s visit Stay Permit.

2. Limited Stay Permit Terms (ITAS)

a). General Requirements, must attach:

  • Application form
  • Guarantee letter from the Guarantor, except for foreigners who are legally married to Indonesian citizens

b). For children born in the territory of Indonesia to parents holding ITK, an ITK can also be made. Parents must fill out the application form and attach:

  • Child’s national passport from the representative of his country in Indonesia
  • Child birth certificate from the hospital or birth certificate from the authorized official
  • Photocopy of parent’s national passport
  • Copy of parent’s visit residence permit.

3. Terms of Permanent Stay Permit (Itap)

  • Filling in form
  • valid national passport and still valid
  • Photocopy of a valid Limited Stay Permit
  • Certificate of domicile
  • The integration statement which has been signed by the person concerned
  • Recommendations from the relevant ministry or non-ministerial government agency.

Children who will follow or join the Itap holder’s parents can also be made Itap. To do this, parents must attach:

  • Guarantee letter from guarantor
  • Photocopy of birth certificate
  • Photocopy of marriage certificate or parents’ marriage book
  • Photocopy of father’s and/or mother’s national passport which is valid and still valid
  • Photocopy of the father’s and/or mother’s valid permanent residence permit
  • Decision regarding the transfer of the status of his residence permit.
